Terms of Service
Last updated
These terms are an agreement between you and Zeroeffort OÜ, a company registered in Estonia (registry code 17225683) that runs adalist (“we” or “us”), about using the adalist website. By creating an account or otherwise using adalist, you agree to these terms. Our Privacy Policy explains how we handle your personal data. If you don't agree to these terms, please don't use adalist.
In short: you must follow the laws of the Turkish Republic of Northern Cyprus (“TRNC”) and never list anything illegal. adalist, Zeroeffort OÜ and the people who run adalist have no responsibility for listings or for anything that happens between users, including scams. Sections 2, 4 and 5 explain this in full.
1. What adalist is
adalist is a place where people post and find listings for second-hand products, services and vehicles. We only provide the platform:
- We're not a party to any deal between users. A sale or service agreement is between you and the other user.
- We don't own or guarantee anything listed. Our team reviews listings against our rules (see section 3), but we never see or check the products, services or vehicles themselves, and we don't check that users are who they say they are.
- adalist doesn't handle payments, deliveries or contracts between users.
- We're not a vehicle dealer.
2. Your account
- You must be at least 18 years old and able to enter into a legally binding contract.
- By creating an account, you agree to follow the laws of the TRNC whenever you use adalist, including in everything you list and every deal you make through it. If you're somewhere else, you must also follow the laws that apply to you there.
- Give accurate information, keep your email address up to date and keep your password safe. You're responsible for what happens on your account, so tell us right away at zeroeffortestonia@gmail.com if someone else uses it.
- One account per person. Don't create more accounts to get around limits or a suspension.
3. Posting listings
When you post a listing, you promise that:
- you have the right to sell or offer what you list, and that it actually exists and is available;
- the listing is accurate: its description, condition, price and photos honestly show what you're offering, and it's in the right category;
- the text and photos are your own, or you have permission to use them;
- the listing and the deal follow every law that applies, including laws on consumer protection, vehicle registration and transfer, licensing for professional services, and tax.
How listings work on adalist:
- Our team reviews every listing before it goes live. We may approve, reject or remove a listing, or edit it, for example to move it to the right category or to take out something that breaks these terms. This review only checks a listing against our rules. It doesn't mean we've checked that the listing is accurate, legal or genuine, or that we vouch for it or for the user who posted it.
- You can have up to 5 listings live or awaiting review at a time. We may change this limit.
- Listings can expire after a while. Close yours when what you're offering is sold or no longer available.
- The phone number on your listing is shown to logged-in users who choose to reveal it.
4. What's not allowed
You must never list or offer anything that's illegal under the laws of the TRNC. In particular, don't use adalist to list, offer or do any of the following:
- Stolen goods, counterfeit or pirated items, weapons and ammunition, illegal drugs, prescription medicines, or anything else that's illegal to sell or offer in the TRNC.
- Sexual content or sexual services.
- Fake, misleading or duplicate listings, listings for things you don't have, or prices you won't honor.
- Scams or fraud, such as asking for payment in advance for something that doesn't exist.
- Harassment, threats, hate speech, or discrimination, including refusing to sell to or serve someone because of their race, ethnicity, nationality, religion, sex, disability or a similar characteristic.
- Spam, or advertising sent to other users who didn't ask for it.
- Collecting other users' phone numbers or other data, scraping the site, or using bots or other automated tools on it.
- Interfering with how adalist works or with its security, or getting around its limits, suspensions or moderation.
- Pretending to be someone else, or a business you don't represent.
If you list or offer something illegal, you alone are responsible for it. We may remove it, close your account, and report it to the authorities.
5. Listings and deals are at your own risk
adalist, Zeroeffort OÜ and the people who run adalist have no responsibility for any listing, for any user, or for anything that happens between users. Each listing is the sole responsibility of the user who posted it, and any deal you make or contact you have with another user is entirely at your own risk. As far as the law allows, we're not responsible for:
- what a listing says or shows, whether it's accurate, complete or legal, or whether what it offers exists;
- the quality, safety, condition, ownership or legality of anything offered;
- whether a user is who they say they are, or whether they'll pay, deliver or keep to a deal;
- any scam, fraud, theft, loss, damage or injury that comes from a listing, a deal or meeting another user, online or in person;
- any dispute between users.
To protect yourself, meet in a safe, public place, check things before you pay, and never pay in advance for something you haven't seen. For vehicles, check the ownership documents and make the transfer through the official channels.
If a deal goes wrong, settle it with the other user. If you've been scammed, report it to the police. Please also report scams, and any listing or user that breaks these terms, to us with the “Report this listing” button on the listing, or by email at zeroeffortestonia@gmail.com.
6. Your content
You keep ownership of the text and photos you post. By posting them, you give us a non-exclusive, worldwide, royalty-free license to store, copy, display, resize and format them in order to run and promote adalist, for example by showing your listing in search results. This license ends once your content is removed from adalist, apart from copies kept for a limited time in backups or that we must keep by law.
You're responsible for what you post. We may remove anything that breaks these terms or the law.
7. Suspension and closing your account
- If you break these terms or the law, or put other users at risk, we may remove your listings and suspend or close your account, for a while or permanently. Where it's reasonable, we'll tell you why.
- While your account is suspended, you can't log in and your listings are hidden.
- You can stop using adalist at any time, and ask us to delete your account by emailing zeroeffortestonia@gmail.com.
- Sections 5, 6, 9, 10, 11 and 13 keep applying after your account ends.
8. Fees
Using adalist is currently free. If we add paid features, we'll show you the price and terms before you pay, and you'll never be charged for something you didn't choose.
9. Our service
We work to keep adalist running well, but we can't promise it will always be available, free of errors or secure, and we may change, add or remove features. adalist is provided “as is”. As far as the law allows, we make no promises about the site or the listings on it, including that listings are accurate or legal, or that what's offered is fit for any purpose.
10. Our liability
- As far as the law allows, neither Zeroeffort OÜ nor the people who run adalist are liable for any loss or damage that comes from listings, from deals between users, or from other users' behavior, including scams and fraud, or for any indirect or consequential losses or lost profits.
- As far as the law allows, our total liability to you for any claim about adalist is limited to what you paid us, if anything, in the 12 months before the claim.
- Nothing in these terms limits liability that the law doesn't allow to be limited, such as for fraud, gross negligence, or death or personal injury caused by negligence.
11. Your responsibility
If you break these terms or the law and that leads to a claim against us, you're responsible for the losses and costs that result, as far as the law allows.
12. Changes to these terms
When we change these terms, we'll update the date at the top. If a change is significant, we'll tell you by email or on the site before it takes effect, and we may ask you to agree to the new version to keep using your account. If you don't agree, you can stop using adalist and ask us to delete your account.
13. Governing law and disputes
These terms are governed by the laws of the Turkish Republic of Northern Cyprus, and its courts will settle any dispute about them. This doesn't take away any right the law gives you to bring a claim in the courts where you live. Before going to court, please contact us so we can try to sort it out together.
14. General
- If any part of these terms can't be enforced, the rest still applies.
- If we don't enforce a right straight away, we haven't given it up.
- You can't transfer your account or your rights under these terms. We may transfer ours to whoever takes over adalist, as long as your rights stay the same.
- These terms are the whole agreement between you and us about adalist.
